1. Acceptance of Terms

By accessing or using GeckoShare (the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, our Privacy Policy, and all applicable laws and regulations.

Who May Use the Service:

• You must be at least 13 years of age to use GeckoShare
• If you are between 13 and 18, you must have parental or guardian consent
• You represent that you have the legal capacity to enter into this agreement
• You agree to use the Service in compliance with all applicable laws in your jurisdiction

We reserve the right to refuse service to anyone at any time for any reason.

2. Description of Service

GeckoShare is a secure, temporary file-sharing platform that enables users to share encrypted files through unique, time-limited links. The Service provides:

2.1 Core Features (All Users)

• End-to-End Encryption: All files are encrypted on your device before upload using AES-GCM encryption. GeckoShare cannot access, decrypt, or view your file contents.
• Unique Download Links: Each uploaded file receives a unique short link with encryption keys embedded in the URL fragment (never sent to our servers).
• Automatic Expiration: Files are automatically deleted according to tier-specific retention policies (see Section 7).
• No Account Required (Guest Tier): Guest users can share files without creating an account.

2.2 Service Tiers

Guest Tier (Free):

• Maximum file size: 5GB per file
• Retention period: 24 hours maximum
• Download limit: One-time download (file auto-deletes after first download)
• No account or wallet connection required

Pro Tier (Token-Gated):

• Maximum file size: 20GB per file
• Retention period: Up to 7 days (File Vault feature)
• Download limit: Unlimited downloads during retention period
• File Vault management interface with manual deletion
• Access logging and download tracking
• Eligibility Requirement: Ownership of ≥10,000 PRICKO tokens in connected Solana wallet

3. User Accounts and Authentication

3.1 Guest Users (No Account)

Guest users may use the Service without creating an account. We collect minimal metadata (IP address for abuse prevention, upload timestamps, file size) as detailed in our Privacy Policy.

3.2 Pro Users (Wallet Authentication)

To access Pro tier features, you must connect a Solana wallet. By connecting your wallet:

• You authorize GeckoShare to perform read-only verification of your PRICKO token balance
• You represent that you control the connected wallet and its private keys
• You acknowledge that GeckoShare NEVER accesses, stores, or controls your private keys, seed phrases, or wallet funds
• You are solely responsible for wallet security, including safeguarding private keys and recovery phrases

No Custody or Control: GeckoShare is a non-custodial service. We cannot recover lost wallets, reset wallet passwords, or reverse blockchain transactions.

4. Prohibited Use

You agree NOT to use GeckoShare to:

4.1 Illegal Content

• Upload, share, or distribute content that violates any applicable law or regulation
• Share child sexual abuse material (CSAM) or content depicting minors in harmful situations
• Distribute malware, viruses, ransomware, or other malicious code
• Share content that facilitates terrorism, violence, or criminal activity
• Distribute stolen data, credentials, or confidential information obtained illegally

4.2 Infringing Content

• Share copyrighted material without authorization (pirated software, movies, music, etc.)
• Violate intellectual property rights, including patents, trademarks, or trade secrets
• Distribute content that infringes on third-party rights of publicity or privacy

4.3 Harmful Content

• Upload content containing personal information of others without consent (doxxing)
• Share non-consensual intimate imagery or deepfakes
• Distribute hate speech, harassment, or content promoting violence
• Share spam, phishing links, or deceptive content

4.4 Abuse of Service

• Circumvent file size limits, retention policies, or download restrictions
• Attempt to reverse-engineer, decompile, or hack the Service
• Use automated scripts, bots, or scrapers to abuse the platform
• Overload or disrupt Service infrastructure (DDoS attacks, rate limit evasion)
• Create multiple accounts or wallets to evade enforcement actions

5. Intellectual Property Rights

5.1 Your Content

You retain all ownership rights to files you upload to GeckoShare. By using the Service, you grant GeckoShare a limited, non-exclusive, worldwide license to:

• Store your encrypted files on our infrastructure (Hetzner Object Storage)
• Transmit files to recipients you designate via download links
• Process file metadata (size, type, timestamps) necessary to operate the Service

Important: Because files are end-to-end encrypted, GeckoShare cannot access file contents. This license is purely technical and does not grant us any intellectual property rights to your content.

5.2 GeckoShare Intellectual Property

The Service, including its software, design, trademarks ("GeckoShare"), logos, and all related intellectual property, is owned by GeckoShare and protected by copyright, trademark, and other laws. You may not:

• Copy, modify, or create derivative works of the Service
• Use GeckoShare trademarks without prior written permission
• Remove or alter copyright, trademark, or proprietary notices
• Frame or mirror any part of the Service without authorization

5.3 DMCA Compliance

GeckoShare respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe content shared via our Service infringes your copyright, please submit a DMCA takedown notice to:

Notice Must Include:

• Identification of the copyrighted work claimed to be infringed
• The specific GeckoShare download link (URL) containing the infringing material
• Your contact information (name, address, email, phone)
• A statement of good faith belief that use is unauthorized
• A statement that the information is accurate and you are authorized to act on behalf of the copyright owner
• Your physical or electronic signature

Limitations: Due to end-to-end encryption, GeckoShare cannot proactively scan file contents for infringing material. We rely on copyright holders to identify specific infringing links. Upon receiving a valid DMCA notice, we will promptly delete the file and associated metadata.

6. Content and File Responsibility

6.1 User Responsibility

You are solely responsible for:

• The content of files you upload and share
• Ensuring you have the legal right to share content with recipients
• Compliance with applicable laws in your jurisdiction and the recipient's jurisdiction
• Securing download links and encryption keys (anyone with the full URL can download the file)
• Verifying recipient identity before sharing sensitive files

6.2 No Content Monitoring

GeckoShare uses end-to-end encryption, which means:

• We CANNOT access, view, or monitor the contents of your files
• We CANNOT proactively screen for illegal, infringing, or harmful content
• We CANNOT decrypt files on your behalf if you lose encryption keys

While we cannot monitor content, we will respond to valid legal requests, DMCA notices, and reports of Terms violations with specific evidence (e.g., a download link to illegal content).

6.3 Reporting Abuse

If you discover content shared via GeckoShare that violates these Terms or applicable law, report it to:

Include the full download link and a description of the violation. We will investigate and take appropriate action.

7. Premium Tier Features (Pro Tier)

7.1 Pro Tier Eligibility

To access Pro tier features, you must:

• Connect a Solana wallet to GeckoShare
• Maintain a balance of ≥10,000 PRICKO tokens in the connected wallet
• Grant GeckoShare permission to perform read-only balance verification

Balance Verification: GeckoShare queries the Solana blockchain to verify your token balance. This is a read-only operation that does not require transaction signatures or access to your private keys.

Real-Time Verification: Pro status is checked dynamically. If your token balance falls below 10,000 PRICKO, you will lose access to Pro features according to the grace period policy (Section 7.3).

7.2 Pro Tier Benefits

File Vault (7-Day Retention):

• Upload files that remain accessible for up to 7 days (vs. 24 hours for Guest tier)
• Files do NOT auto-delete after first download (unlimited downloads during retention period)
• Manual deletion available at any time via Vault management interface
• Files automatically expire and are permanently deleted after 7 days

Increased Storage Limits:

• Maximum file size: 20GB per file (vs. 5GB for Guest tier)
• Total Vault storage capacity: 20GB concurrent storage
• No limit on number of files (subject to 20GB total storage cap)

Enhanced Features:

• File Vault management dashboard with visual usage metrics
• Download tracking and access logs (view when files were accessed)
• Batch file management (delete multiple files simultaneously)
• Custom expiration settings (1-7 days, configurable per file)

7.3 Token Requirements and Downgrade Policy

Balance Monitoring: GeckoShare checks your PRICKO token balance:

• When you connect your wallet
• When you attempt to upload a file to the Vault
• Periodically during active sessions

Downgrade Process (Balance Falls Below 10,000 PRICKO):

1. Grace Period: You have 24 hours to restore your balance to ≥10,000 PRICKO
2. Feature Lock: During the grace period, you cannot upload new files to the Vault but can still access and download existing Vault files
3. Automatic Downgrade: If balance remains below 10,000 PRICKO after 24 hours:
   • Existing Vault files remain accessible until their original expiration dates (no early deletion)
   • You cannot upload new files with Pro features
   • Future uploads default to Guest tier (24-hour retention, one-time download)
4. Restoration: If you later restore your balance to ≥10,000 PRICKO, Pro features are immediately reinstated

7.4 Token Acquisition and Risks

GeckoShare's Role:

• We ONLY verify that your wallet contains ≥10,000 PRICKO tokens
• We do NOT custody, transfer, freeze, or otherwise control your tokens
• We do NOT facilitate token purchases or exchanges
• We have NO affiliation with PRICKO token issuers or developers

How to Acquire PRICKO Tokens:

PRICKO tokens must be obtained through third-party cryptocurrency exchanges or decentralized finance (DeFi) platforms. You are responsible for:

• Researching and selecting a reputable exchange or platform
• Completing any required identity verification (KYC) with the exchange
• Understanding exchange fees, withdrawal limits, and terms of service
• Transferring purchased tokens to your Solana wallet
• Securing your wallet and private keys

Cryptocurrency Risks (You Acknowledge and Accept):

• Price Volatility: PRICKO token prices can fluctuate significantly. The USD value of 10,000 PRICKO tokens may increase or decrease dramatically.
• No Price Guarantee: GeckoShare does not guarantee token prices or liquidity. The threshold is denominated in tokens (10,000 PRICKO), not USD value.
• Irreversible Transactions: Blockchain transactions cannot be reversed. Sending tokens to the wrong address may result in permanent loss.
• Regulatory Risk: Cryptocurrency regulations vary by jurisdiction and may change. You are responsible for understanding your local laws.
• Exchange Risk: Third-party exchanges may experience outages, hacks, insolvency, or regulatory actions.
• Wallet Security: If you lose your private keys or seed phrase, you will permanently lose access to your tokens. GeckoShare cannot recover lost wallets.
• Blockchain Risk: Solana network congestion, outages, or forks may temporarily affect token balance verification.

7.5 No Investment Advice or Securities Offering

PRICKO Tokens as Utility Tokens: PRICKO tokens are used solely as a utility token to gate access to Pro tier features. Token ownership:

• Does NOT represent an investment contract or security
• Does NOT provide ownership, equity, or profit-sharing rights in GeckoShare
• Does NOT entitle you to dividends, revenue sharing, or business governance rights
• Does NOT constitute a promise of future returns or appreciation

No Financial Advice: GeckoShare does NOT provide financial, investment, tax, or legal advice regarding cryptocurrency. You should:

• Consult a licensed financial advisor before purchasing cryptocurrency
• Consult a tax professional regarding cryptocurrency tax implications in your jurisdiction
• Conduct independent research before acquiring PRICKO tokens

No Endorsement: GeckoShare's use of PRICKO tokens for access gating does NOT constitute an endorsement, recommendation, or guarantee of token value or performance.

7.6 Storage Limits and Overage

20GB Total Storage Cap: Pro users may store up to 20GB of files concurrently in the Vault.

How Storage is Calculated:

• Each uploaded file consumes storage equal to its encrypted file size
• Storage is released when files expire or are manually deleted
• Example: If you have 15GB of files in your Vault, you have 5GB remaining capacity

Exceeding the Limit:

• If your Vault reaches 20GB, you CANNOT upload additional files until storage is freed
• Delete existing files or wait for automatic expiration to free space
• You will receive a clear error message indicating storage is full

No Overage Charges: GeckoShare does NOT charge overage fees, automatically upgrade your storage, or delete files without your consent to make room. You are in full control of Vault contents.

7.7 File Retention and Deletion

Automatic Expiration:

• Vault files automatically expire 7 days after upload (or your custom expiration, if set shorter)
• Expired files are permanently deleted from our servers and cannot be recovered
• You will receive a warning notification 24 hours before a file expires (if you provide contact information)

Manual Deletion:

• You may delete Vault files at any time via the Vault management interface
• Deletion is immediate and irreversible
• Associated download links will immediately return "File Not Found" errors

Data Deletion Upon Downgrade:

• If you lose Pro status (token balance falls below 10,000 PRICKO), existing Vault files are NOT deleted early
• Files remain accessible until their original expiration dates
• You cannot upload new files with Pro features until balance is restored

No Backup or Recovery: GeckoShare does not maintain backups of expired or deleted files. Once deleted, files are permanently gone.

7.8 No Guarantee of Availability

Pro tier features depend on external systems beyond GeckoShare's control, including:

• Solana Blockchain: Network outages, congestion, or forks may prevent token balance verification
• Solana RPC Providers: Third-party API providers may experience downtime or rate limiting
• Wallet Software: Wallet adapter bugs or incompatibilities may prevent wallet connection

GeckoShare makes reasonable efforts to maintain service availability but does NOT guarantee:

• Uninterrupted access to Pro tier features
• Real-time token balance updates during blockchain outages
• Compatibility with all Solana wallets (we support major wallets like Phantom, Solflare, etc.)

Temporary Outages: If the Solana network or RPC providers experience outages, token balance verification may temporarily fail. During such outages:

• Users with previously verified Pro status may retain access temporarily (grace period)
• New Pro tier activations may be delayed until services are restored
• We will display clear error messages explaining the issue

7.9 Modifications to Pro Features

GeckoShare reserves the right to modify Pro tier features, requirements, or token thresholds with 30 days' advance notice. Potential changes include (but are not limited to):

• Adjusting the PRICKO token threshold (e.g., increasing from 10,000 to 15,000 tokens)
• Changing retention periods (e.g., reducing from 7 days to 5 days)
• Modifying storage limits (e.g., changing from 20GB to 15GB)
• Adding or removing Pro tier features
• Changing supported blockchains or tokens

Grandfathering: Existing Vault files uploaded before a change takes effect will honor the original retention period and limits. Changes apply to new uploads after the effective date.

Notification: We will notify Pro users of changes via:

• Email (if you've provided a contact email)
• Banner notifications on the GeckoShare website
• Updates to these Terms of Service with a revised "Last Updated" date

Right to Discontinue: GeckoShare reserves the right to discontinue Pro tier features entirely with 60 days' notice. In such an event, existing Vault files will remain accessible until their original expiration dates.

8. Data Retention and Expiration

8.1 File Retention Policies

Guest Tier Files:

• Maximum Retention: 24 hours from upload
• Download Limit: One-time download (file auto-deletes after first successful download)
• Automatic Deletion: Files are permanently deleted after 24 hours OR after first download, whichever occurs first

Pro Tier Vault Files:

• Maximum Retention: 7 days from upload (or custom expiration up to 7 days)
• Download Limit: Unlimited downloads during retention period
• Automatic Deletion: Files are permanently deleted after expiration date
• Manual Deletion: You may delete files at any time before expiration

8.2 Metadata Retention

GeckoShare retains minimal metadata about file uploads for operational and security purposes:

What We Retain (All Users):

• File size and MIME type (not file names, which are encrypted)
• Upload timestamp and expiration date
• IP address of uploader (for abuse prevention, retained 90 days)
• Short link code (anonymous identifier)

Additional Metadata (Pro Users):

• Solana wallet public address (retained 90 days after last connection)
• Download timestamps and access logs (retained 90 days after file deletion)
• Storage usage metrics (retained while account is active)

Metadata Deletion: Metadata is automatically deleted according to the retention periods specified in our Privacy Policy (typically 90 days after file deletion). You may request early deletion by contacting privacy@privacygecko.com.

8.3 Encryption Keys

Zero-Knowledge Architecture: Encryption keys are NEVER transmitted to or stored on GeckoShare servers. Keys are:

• Generated on your device during file upload
• Embedded in the URL fragment (the part after "#" in the URL)
• Transmitted directly from your browser to the recipient's browser

Key Loss: If you lose a download link or the URL fragment is corrupted, the file CANNOT be decrypted or recovered. GeckoShare does not have access to encryption keys and cannot help with key recovery.

8.4 Right to Early Deletion

GeckoShare reserves the right to delete files before their scheduled expiration date if:

• Files violate these Terms (illegal content, malware, abuse, etc.)
• Files are subject to a valid DMCA takedown notice
• Files are subject to a valid law enforcement request or court order
• Technical issues require emergency file deletion (e.g., data corruption, security breach)
• Service infrastructure is discontinued or migrated

We will make reasonable efforts to notify affected users (if contact information is available) but are not obligated to do so.

9. Limitation of Liability

9.1 Service "As-Is" Disclaimer

GeckoShare is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• No warranty of uninterrupted service: We may experience downtime, outages, or technical issues
• No warranty of error-free operation: Software bugs, data corruption, or upload failures may occur
• No warranty of security: While we implement industry-standard security measures, no system is 100% secure
• No warranty of data preservation: Files may be lost due to technical failures, security breaches, or legal compliance
• No warranty of Pro tier availability: Pro features depend on external blockchain services that may experience outages

9.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

GeckoShare, its officers, directors, employees, affiliates, and service providers SHALL NOT BE LIABLE for any:

• Indirect, incidental, special, consequential, or punitive damages arising from use of the Service
• Loss of profits, revenue, data, or business opportunities
• Loss or corruption of files (whether due to technical failures, early deletion, or expiration)
• Inability to access Pro tier features (due to blockchain outages, wallet issues, or token balance changes)
• Cryptocurrency losses (including price volatility, hacking, or loss of wallet access)
• Unauthorized access to your files (if you share download links insecurely)
• Third-party claims (including DMCA claims, privacy violations, or defamation arising from your uploaded content)
• Service interruptions, downtime, or bugs

EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9.3 Maximum Liability Cap

In no event shall GeckoShare's total aggregate liability to you for all claims arising from or related to the Service exceed:

• Guest Users: $0 USD (the Service is free)
• Pro Users: $100 USD or the USD value of 10,000 PRICKO tokens at the time of the claim, whichever is LOWER

This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, etc.) and regardless of the number of claims.

9.4 Essential Purpose

You acknowledge that these limitations of liability are an essential part of the agreement between you and GeckoShare. GeckoShare would not provide the Service without these limitations.

9.5 Jurisdictional Variations

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. In such jurisdictions, the above limitations may not apply to you, and GeckoShare's liability will be limited to the maximum extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless GeckoShare, its officers, directors, employees, affiliates, contractors, and service providers from any and all:

• Claims, lawsuits, or legal actions
• Damages, losses, liabilities, and expenses (including reasonable attorneys' fees)

Arising from or related to:

• Your use of the Service (including any content you upload, share, or download)
• Violation of these Terms (including prohibited use, intellectual property infringement, or illegal content)
• Violation of any law or regulation (including privacy laws, copyright law, or criminal law)
• Infringement of third-party rights (including intellectual property, privacy, or publicity rights)
• Cryptocurrency transactions (including token purchases, wallet security failures, or blockchain disputes)
• Unauthorized disclosure of download links (if you share links with unintended recipients)

Example: If you upload copyrighted material without authorization and the copyright holder sues GeckoShare, you agree to reimburse GeckoShare for legal fees and any settlement or judgment.

11. Dispute Resolution

11.1 Informal Resolution

Before initiating formal dispute resolution, you agree to contact us at legal@privacygecko.com and attempt to resolve the dispute informally for at least 30 days.

11.2 Governing Law

These Terms are governed by the laws of [JURISDICTION TO BE DETERMINED - recommend European Union or Delaware, USA depending on company incorporation], without regard to conflict of law principles.

11.3 Arbitration Agreement (If Applicable)

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by [ARBITRATION PROVIDER] under its rules. Arbitration will be conducted in [LOCATION]. Each party will bear its own costs.

Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in class action lawsuits or class-wide arbitration.

If arbitration does not apply, you agree that any legal action arising from these Terms must be filed in the courts of [JURISDICTION], and you consent to the exclusive jurisdiction of those courts.

11.5 Exceptions

Either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights.

12. Changes to Terms

12.1 Right to Modify

GeckoShare reserves the right to modify these Terms at any time. When we make changes:

• We will update the "Last Updated" date at the top of this document
• Material changes will be announced via banner notification on the GeckoShare website
• Pro users will receive email notification (if contact information is provided)
• Changes will take effect 30 days after posting (or immediately if required by law)

12.2 Acceptance of Changes

By continuing to use GeckoShare after changes take effect, you accept the modified Terms. If you do not agree to the changes:

• You must stop using the Service
• Delete any files from your Vault before the effective date
• Disconnect your Solana wallet

12.3 Notification of Material Changes

We will provide 30 days' advance notice for material changes, including:

• Changes to Pro tier token requirements (e.g., increasing from 10,000 to 15,000 PRICKO)
• Changes to retention periods or storage limits
• Changes to liability limitations or dispute resolution procedures
• Introduction of new fees or charges

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and GeckoShare regarding the Service and supersede all prior agreements or understandings.

13.2 Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

13.3 Waiver

GeckoShare's failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of GeckoShare.

13.4 Assignment

You may not assign or transfer these Terms or your rights under them without GeckoShare's prior written consent. GeckoShare may assign these Terms without restriction (e.g., in connection with a merger, acquisition, or sale of assets).

13.5 Force Majeure

GeckoShare is not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including:

• Natural disasters, war, terrorism, pandemics
• Government actions, laws, or regulations
• Blockchain network failures or outages
• Third-party service provider failures (Hetzner, Solana RPC, CDN, etc.)
• Internet infrastructure failures or cyberattacks

13.6 Survival

Sections that by their nature should survive termination of these Terms will survive, including: Intellectual Property, Limitation of Liability, Indemnification, Dispute Resolution, and General Provisions.

13.7 Relationship

Nothing in these Terms creates a partnership, joint venture, agency, employment, or fiduciary relationship between you and GeckoShare. You are an independent user of the Service.
